Investigations revealed that Wagner allegedly diverted funds meant for business ventures to finance a lavish lifestyle, acquiring luxury assets in a Ponzi scheme-like operation.
In January 2023, Wagner’s company, WAGSCAP LLC, purchased Bergies Coffee in Downtown Gilbert for $3.1 million, with a $1 million down payment and a seller carryback agreement with the previous owner. Rumors suggest that WAGSCAP LLC is now attempting to sell the land for $4 million, adding to the uncertainty surrounding Wagner’s business activities as he faces mounting legal and financial pressures.
In Scottsdale, Wagner encountered resistance with his Swags project, which was ultimately rejected by City Council due to neighboring business objections. Meanwhile, Bottled Blonde’s future in Gilbert remains unclear as local officials and business owners await further developments amid Wagner’s ongoing legal issues.
Federal prosecutors have labeled Wagner a flight risk, accusing him of obstructing justice and intimidating witnesses. Investors, including some in Gilbert, are uncertain about recovering their investments, casting further doubt on Wagner’s business ventures.
